Acceptance of the Terms of Service
The following terms and conditions (“Terms”) apply to your use of the websites of OBM Digital Factory BV and the OBM Group with headquarters in Nieuw-Vennep Netherlands (“OBM”, “we” “us” or “our”), including of all content, functionality, products and services offered on or through such websites (collectively, the “Website”), whether as a guest or as a registered user. These Terms also apply to your use of other OBM Digital Factory services that display or contain these Terms (“Additional Services”). In these Terms, the Website and Additional Services are collectively referred to as the “Services”.
Please read these Terms carefully before using the Services. By using the Services, you accept and agree to be bound by and abide by these Terms of Service. If you do not agree to these Terms of Service, you may not use the Services. In addition to these Terms, any software or services included in or otherwise made available to you through the Services may be subject to a separate agreement between you and OBM Digital Factory, such as end user license agreements. If these Terms are inconsistent with such agreements, those agreements shall prevail.

Intellectual property rights
The Services, including all content, features and functionality thereof, are owned by OBM Digital Factory, it’s licensors or other suppliers of such material. You may use the Services only for your personal, non-commercial use or legitimate business purposes related to your role as a current or prospective customer of OBM Digital Factory. All other rights are reserved by OBM Digital Factory.
Prohibited use
You may use the Services only for lawful purposes and in accordance with these Terms and Conditions. You agree not to access or use the Services for any purpose that is unlawful or beyond the scope of the intended use of the Services (at OBM Digital Factory’s sole discretion).
Disclaimer of Warranties
The Services and all information, content, materials, products (including software) and other services included in or otherwise made available to you through the Services are provided by OBM Digital Factory on an “as is” and “as available” basis. OBM Digital Factory makes no representations or warranties of any kind, express or implied, with respect to the operation of the Services, or the information, content, materials, products (including software) or other services contained in or otherwise available to you are made through the Services.
To the fullest extent permitted by law, OBM Digital Factory disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. OBM Digital Factory does not warrant that the Services, information, content, materials, products (including software), or other services included on or otherwise made available to you through the Services, OBM Digital Factory’s servers, or electronic communications transmitted by OBM Digital Factory, are free contain viruses or other harmful components.
Limitation of Liability
To the extent permitted by law, OBM Digital Factory shall not be liable for any loss of profits or any indirect, incidental, punitive, special or consequential damages arising out of or in connection with this Agreement. Further, to the fullest extent permitted by law, nothing in these Terms shall exclude or in any way limit OBM Digital Factory’s liability for death or personal injury caused by its negligence or for fraud or any other liability to the extent that the same may not be excluded or limited as a legal matter.
Disclaimer
You agree to defend, indemnify and hold harmless OBM Digital Factory, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against all claims, liabilities, damages, judgments, awards , losses, costs, expenses or fees (including reasonable attorneys’ fees) as a result of any violation of these terms.
Applicable Law and Jurisdiction
Any dispute or claim by you arising out of or in connection with these Terms (“Claim”) shall be governed by Dutch law without giving effect to any choice or conflict of law provision or rule. Any lawsuit, action or proceeding arising out of or in connection with any Claim shall be submitted exclusively to the courts of the Netherlands. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
